The earlier POS Advice Note has been updated (February 2015)
POS originally produced an advice note in March 2011. This note supersedes the 2011 version, bringing the advice up to date both in respect of the changes in the regulations and experience of authorities in implementing CIL.
The Community Infrastructure Levy (CIL) Regulations have significant implications for the use of S106 Planning Obligations, both for authorities who have or are intending to introduce CIL and for those who are not. CIL and S106 are both tools available to LPAs to fund and deliver infrastructure. To achieve maximum effectiveness authorities should treat them as complementary mechanisms. This note is intended to provide helpful and constructive advice to Local Planning Authorities on how this can be achieved.
