2      SPATIAL PLANNING LATEST

Legal Challenge over Revocation of RSSs

Edinburgh-based Cala Homes has made an application for Judicial Review of the recent decision by Communities secretary Eric Pickles to revoke regional strategies on 6 July 2010. It believes the Secretary of State acted unlawfully as the move required primary legislation and that transitional arrangements should have been put in place before the announcement.

The grounds for the claim focus on an application by the house builder for 2,000 homes on a site in Winchester, Hampshire, which was turned down in June. Cala Homes argues that no appeal can take place while there is an absence of planning policy.
